Tours Terms & Conditions

1.        Agreement to Terms

By booking an Experience with Oxley Hill Farm Flowers (“we” or “us”), you agree to be bound by these Terms and Conditions.  

2.       Cancellations & Refunds for Experiences (such as workshops and tours)

Refunds for Farm Experience fees will only be issued under the following circumstances:·     

• If theExperience is cancelled/rescheduled due to illness of the host or artist.·     
• If theExperience is cancelled/rescheduled due to severe weather conditions, natural disasters or safety concerns.·     
• If the event fails to meet the minimum required enrolments.  

If an Experience is cancelled or rescheduled under these circumstances, we will contact all enrolled participants, and you will be offered the option to either:

1. Attend at an alternative date, subject to availability; or 
2. Receive a full refund. 

Refunds will not be granted in the following cases:·     

• Oxley Hill FarmFlowers is not responsible for personal circumstances that prevent attendance, nor for cancellations caused by change of mind or government restrictions.·     
• Should you choose to withdraw from the event, your fees are non-refundable. However, you may transfer your ticket to someone else; it is your responsibility to arrange the transfer and notify us of the name change prior to the scheduled event, so the new attendee can participate in the Experience. The new attended will also need to agree to these Terms and Conditions.·     
• It is your responsibility to ensure you attend the event at the scheduled time. If you arrive late or miss the Experience entirely, we are unable to provide a refund or reschedule your participation.·     
• It is your responsibility to check and ensure you meet any specific health or fitness requirements of the Experience prior to booking. If you are unable to meet these requirements, we are unable to offer a refund.·     
• We reserve the right to modify or alter the content, structure, or schedule of the Experience, including but not limited to activities and locations, if necessary due to operational requirements or safety concerns. We are not liable for any changes made and will notify participants of any significant alterations when possible. 

3.       Participant Responsibilities

As a participant, you are required to:·     

• Follow all instructions and adhere to safety guidelines provided by Oxley Hill Farm Flowers staff. Failure to comply may result in your immediate removal from the Experience, with no refund provided.     
• Refrain from dangerous or disruptive behaviour. Dangerous or hazardous items are not permitted, and any disruptive or harmful behaviour will result in removal from the event without refund.·     
• Inform Oxley Hill Farm Flowers staff of any pre-existing medical conditions in advance. We are not liable for any issues that arise from your participation, even if you have disclosed relevant health information. You are responsible for ensuring you are fit to participate in the event.  

We are not responsible for any loss, damage, or theft of your personal belongings. Please always keep your belongings secure and with you. 

4.       Limitation of Liability

While we take every effort to ensure a safe and secure Experience, Oxley Hill FarmFlowers and its employees, agents and contractors cannot be held liable for any loss, damage, accident, injury or death that may occur during your participation in an Experience. By participating in an Experience, you acknowledge and accept that:·     

• Oxley HillFarm Flowers is a working farm environment, and there are inherent risks and hazards associated with our activities. These may include, but are not limited to, risks related to equipment, terrain and weather conditions.·     
• You agree to participate in the Experience at your own risk and are responsible for assessing whether the Experience is suitable for you.·     
• While we may provide basic first aid assistance, Oxley Hill Farm Flowers is not responsible for medical treatment, health conditions, or injuries that may arise during the Experience.·     
• Oxley HillFarm Flowers is not responsible for any actions, omissions or negligence of third parties, including but not limited to other participants, that may result in injury, loss, or damage during the Experience.·     
• Oxley HillFarm Flowers is not liable for any indirect or consequential loss resulting from your participation in the Experience.·     
• Our liability is limited to the amount paid for the Experience, except where prohibited by law. 

5.       Indemnity

By participating in the Experience, you agree to indemnify, defend and hold harmless Oxley Hill Farm Flowers and its employees, agents and contractors from and against all claims, actions, losses, damages and expenses (including legal fees), or costs arising out of or inc onnection with your participation in the Experience, including but not limited to:

• any injury, loss, death or damage to yourself or others caused by your actions, negligence or failure to comply with these Terms andConditions, our safety guidelines or instructions provided by Oxley Hill Farm Flowers staff during the Experience.
• any third-party claims arising from your conduct during the Experience, including damage to property or injury to other individuals. 

6.       Photography & Videography

During the Experience, photographs and videos may be taken for promotional purposes. By attending the Experience, you consent to being photographed, filmed, or recorded as part of the event. These images and videos may be used on our website, social media, and other marketing materials. 

If you prefer not to be photographed or recorded, please inform a staff member before the session begins. We will make reasonable efforts to accommodate your request. If you do not inform staff and are later identified in any promotional content, Oxley Hill Farm Flowers will not be held liable for any use of such media. 

7.       Governing Law

These Terms and Conditions are to be governed and construed in accordance with all applicable laws in force in New South Wales, Australia.
